What Are Civil Rights?
Civil rights are privileges that are protected by laws. In general, people believe they are owed a life without extreme suffering. When people reside in or contribute to an organized social structure such as a state or country, governing authorities hold a responsibility to mitigate forms of undue suffering.
When a group or individual experiences harm or restriction in their ability to live freely, they may be able to push for reform through organization, advocacy, and protest. This can lead to the enactment of laws by the governing authority.
How Can You Decide If Something Should Be A Civil Right?
Is it a privilege granted to other groups?
Does it negatively affect your quality of life?
Does it reinforce universal freedom?
Protection Against Discrimination
When groups of people interact, perceived differences might create inequality. If a group experiences preferential or deferential treatment, their quality of life may be affected by how they are perceived. When those effects are harmful, civil rights movements emerge.
These organized efforts have led to protections for features that may characterize groups. In some countries, individuals in positions of authority such as employers and landlords are not allowed to discriminate on the basis of gender, race, ethnicity, age, sexual orientation, or disability status. When unlawful discrimination occurs, the harmed individual or group is owed remediation.
The Right To Free Expression
As members of society, restrictions on expression have potential to disable our ability to protest mistreatment. To protect against retaliation, censorship, or legal sanctions, some governing authorities guarantee the right to free expression as well as non-expression. This can include speech, religion, journalism, organizing in groups, and expressing complaints or seeking assistance from the government.
These rights are applicable in settings where public funds are applied, such as a public schools and state agencies. Regardless of setting, when forms of expression are unlawful or abusive, governments may enact restrictions.
The Right To An Education
Education can have a significant impact on wellbeing. If reading, writing, and logic become barriers to information, inequalities may arise. The right to an education provides foundational knowledge for participating in society and benefitting from collective information.
In some countries, every individual is guaranteed access to publicly-funded education for a defined number of years.
The Right To Vote
Participating in elections is one way individuals can shape their community. If the right to vote is restricted, imbalances may lead to legislation that is preferential to specific individuals and prevent others from meaningfully expressing their needs. Voting rights in some countries have been restricted on the basis of race, gender, level of education, age, disability status, and wealth.
The Right To A Fair Election
Elections determine which individuals or representatives occupy positions of power. These decisions affect what laws are made, how they are enforced, and how resources are shared. If the process or its outcome is biased toward a particular candidate due to unlawful means, those positions of power may become occupied by individuals who do not represent their citizens. Some examples of inquitable practices include coercion, diluting or concentrating voting power, inaccurate vote counting, disallowing competition, and imbalance of candidate resources.
Additional Examples of Rights
Freedom from slavery.
Free movevement within or the ability to leave a country.
Fair trial and legal representation.
Freedom from arbitrary arrest, detention, or exile.
Asylum from persecution.
Presumption of innocence until proven guilty.
Limitations on working hours.
A standard of living to maintain health.
What If Civil Rights Conflict With One Another?
In some instances, individuals exercising their rights may be in conflict, leading to disruption in safety or wellbeing. If conflicts arise, governing authorities may consider the existing legal framework, available resources, and the potential or realized harm associated with each action. Under specific circumstances, such as in an emergency, some rights may be restricted. Additionally, rights may have specific limitations and degrees of legal protection.
